A FAMILY has filed a lawsuit after their three-year-old boy was crushed to death when a heavy stone sign collapsed on him at a local park as his father and sister watched in horror.

Kaleb Ortega, 3, suffered fatal crushing injuries at Rooks Park in Walla Walla, Washington, when a large boulder holding an informational panel toppled and fell on him.

The incident occurred on April 1, Elkhorn Media Group reported, and the display had been installed in 2019 as part of an Eagle Scout project.

The lawsuit, filed by the boy’s parents — Miguel and Claudia — targets the companies behind the boulder’s design, manufacture and installation, the outlet reported.

They alleged the structure was top-heavy, unstable and inadequately anchored for a public park where children could foreseeably climb or play.

Claudia, a nurse, was on duty at the hospital when her son arrived by ambulance — and was forced to watch as doctors desperately fought to save his life.

The family is seeking unspecified damages for wrongful death and emotional distress.

The US Army Corps of Engineers shut down Rooks Park in the aftermath and fenced off the area where the boulder had fallen, with the monument later removed entirely, the outlet reported.

“On what started as a normal, happy day filled with play, an unimaginable accident occurred that took Kaleb from us far too soon,” family member Mimi Garcia wrote on GoFundMe.

Garcia added: “While we are overwhelmed with grief, we are also holding tightly to the countless beautiful memories he gave us memories that feel like precious gifts.”

His family remembered Ortega as a bright and joyful child, saying he brought immeasurable joy to everyone who knew him.

“Kaleb had a special love for monster trucks and took such pride in his collection,” Garcia said.

“Each night before bed, he would carefully line them up, showing his sweet and thoughtful little personality.

“His smile and those beautiful, bright eyes could light up a room, and he was deeply loved by everyone who knew him.”

Garcia added: “He brought so much joy to his family and friends, and being with him was something truly special.”

Rooks Park did not immediately respond to The U.S. Sun’s request for comment.
